These Terms of Service apply to the use of massimocastelli.it (the “Site”) and to all orders placed through it. By registering, browsing the Site or placing an order you accept these terms.

NEXUS MODE SRL is the seller. Orders are prepared and dispatched from Italy by our logistics partner ART LOGISTIC DI CM, Via Ettore Majorana 55, 50019 Osmannoro, Sesto Fiorentino, Firenze, Italy.

2. Business customers only

The Site is a wholesale site intended for business customers only: retailers, boutiques, brands and other companies. By registering or placing an order you confirm that you are buying in the course of your trade, business or profession and not as a consumer.

3. Account

You need an account to see prices and to place orders. You agree to provide accurate and complete company information and to keep your login details confidential. We may refuse a registration or close an account at any time, for example when the information provided is false or when the account is not used for business purposes.

4. Products and prices

We make every effort to show our products, colours and descriptions accurately. Leather is a natural material: small differences in colour and grain between the pictures and the product are normal and are not defects.

Prices are shown in euro and do not include VAT, shipping costs or customs duties, unless stated otherwise. VAT is applied according to the applicable law. Prices and volume prices may change at any time; the price that applies to your order is the one shown when the order is placed.

5. Minimum order

The minimum order is 300 euro. It is calculated on the value of the goods only, excluding VAT and shipping costs.

6. Availability

Items in stock are shipped as described in our Shipping policy. Items marked as made to order are produced after your order and are shipped in approximately 14 days from order confirmation. The times indicated are estimates: a delay does not give the right to cancel the order or to compensation, unless agreed otherwise in writing.

7. Orders

An order is binding for you when you place it. It is accepted by us when we send the order confirmation. We may refuse or cancel an order, in whole or in part, for example when a product is no longer available, when there is an obvious error in the price or in the description, or when the payment is not received. In that case any amount already paid for the cancelled items is refunded.

8. Payment

Orders are paid with the payment methods shown at checkout. The goods remain our property until full payment has been received.

9. Shipping and customs

We ship worldwide. Delivery times, shipping costs and conditions are described in our Shipping policy. For orders shipped outside the European Union, import duties, taxes and customs fees may apply; they are set by the destination country and are paid by the customer.

Please check the parcel on delivery. If it arrives visibly damaged, note it on the courier's delivery receipt and send us photos of the parcel and of the goods.

10. Returns

Because all sales are business-to-business, returns are accepted only for defective, damaged or wrong products, as described in our Returns & Refunds policy.

11. Use of the Site and of our content

The Site, the brand Massimo Castelli, the pictures and the texts belong to us or to our licensors. Customers with an approved account may use our product pictures and descriptions only to resell the products purchased from us. Any other use requires our written permission.

You agree not to use the Site for unlawful purposes, not to provide false information, not to interfere with the security of the Site and not to collect data from it by automated means.

12. Liability

We are not responsible for delays or failures caused by events beyond our reasonable control, such as strikes, transport or customs delays, or failures of third-party services. To the maximum extent permitted by law, our total liability for any claim related to an order is limited to the amount paid for that order, and we are not liable for indirect losses such as lost profits or lost sales. Nothing in these terms limits liability that cannot be limited under the applicable law.

13. Personal information

We process personal information as described in our Privacy policy.

14. Governing law

These terms and all orders placed through the Site are governed by the laws of Romania. Any dispute is submitted to the competent courts of the registered office of NEXUS MODE SRL, without prejudice to any mandatory rules that cannot be excluded under the applicable law.

15. Changes to these terms

We may update these terms at any time by publishing the new version on this page. The version in force when an order is placed applies to that order.
